Please read these Terms of Service carefully before using our store and website. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

These Terms of Service ("Terms") govern your use of the Phantom Spirits online store and website, including all products, content, tools and services offered through it (the "Services"). The terms "we", "us" and "our" refer to Phantom Spirits 2.0 ApS, a company incorporated in Denmark.
By using our Services, you confirm that you are of legal age to purchase alcohol in your country of residence, and that you have read and agree to these Terms together with our Privacy Policy.
You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer or assign your account to any other person.
SECTION 2 — OUR PRODUCTS
We take care to represent our products accurately, but colours and appearance may vary depending on your device and settings. We do not warrant that product descriptions, images or quality will meet your exact expectations.
All product descriptions are subject to change without notice. We reserve the right to discontinue any product, and may limit quantities available to any person or region at our discretion.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm it and have successfully processed your payment. We reserve the right to decline any order at our discretion.
Please review your order carefully before submitting. Cancellation may not be possible once an order is accepted. If we decline, change, or cancel your order, we will contact you using the details you provided.
All purchases are subject to our Refund Policy [LINK]. Products are intended for your personal use and not for commercial resale or export.
SECTION 4 — PRICES & PAYMENT
Prices are subject to change without notice. The price charged will be the price shown at the time your order is placed, as set out in your order confirmation. Prices do not include applicable taxes, shipping, or customs charges unless expressly stated.
You agree to provide accurate and complete payment information. You warrant that you are authorised to use the payment method provided, and that all charges will be honoured.
SECTION 5 — SHIPPING & DELIVERY
All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing, or events outside our control. Risk of loss passes to you once we transfer your order to the carrier.
SECTION 6 — INTELLECTUAL PROPERTY
All content on our Services — including trademarks, text, images, graphics, audio and video — is owned by Phantom Spirits 2.0 ApS or its licensors and is protected by applicable intellectual property laws.
You may use our Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. All rights not expressly granted are reserved.
SECTION 7 — THIRD-PARTY TOOLS & LINKS
Our Services may include access to tools or links provided by third parties. We do not control, monitor or endorse such tools or content, and we accept no liability for your use of them. Any use of third-party tools is at your own risk.
SECTION 8 — RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify. All purchases are made directly with Phantom Spirits 2.0 ApS — not with Shopify. Shopify is not responsible for any aspect of transactions between you and us, including any injury, damage or loss arising from purchased products. By using our Services, you release Shopify and its affiliates from all such claims.
SECTION 9 — PRIVACY
Your personal information is handled in accordance with our Privacy Policy [LINK]. By using our Services, you acknowledge that information may be shared with Shopify and other service providers in order to operate and improve the Services.
SECTION 10 — FEEDBACK & REVIEWS
If you submit any feedback, reviews or suggestions, you grant us a perpetual, royalty-free licence to use and publish that content for any purpose. You warrant that you own the rights to anything you submit, and that your submissions are accurate and comply with these Terms.
SECTION 11 — ERRORS & INACCURACIES
We reserve the right to correct any typographical errors, inaccuracies or omissions at any time, including after an order has been submitted, and to update or cancel orders where information was inaccurate.
SECTION 12 — PROHIBITED USES
You may only use our Services for lawful purposes. You may not use the Services to:
• violate any applicable law or regulation;
• infringe our intellectual property rights or those of any third party;
• transmit false, misleading or harmful content;
• send unsolicited commercial communications;
• upload or transmit viruses or malicious code;

• use automated tools (including scrapers, bots or AI agents) to access the Services without our consent; or
• interfere with or circumvent security or access controls.
We reserve the right to suspend or terminate your account if we determine you have violated these Terms.
SECTION 13 — AUTOMATED AGENTS
If you use or deploy automated software or agents ("Agents") to interact with our Services, those Agents must:
• identify themselves as Agents in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user-agent string;
• not conceal or impersonate human behaviour;
• answer truthfully if asked whether interactions are from a human or automated system; and
• comply with any technical or other measures we implement to control Agent access.
We may limit or block Agent access at any time.
SECTION 14 — TERMINATION
We may terminate or suspend your access to the Services at any time without notice. You remain liable for all amounts owing up to the date of termination. Sections relating to intellectual property, liability, indemnification and governing law survive termination.

OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
SECTION 16 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY DANISH LAW, PHANTOM SPIRITS APS AND ITS PARTNERS, DIRECTORS, EMPLOYEES AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SECTION 17 — INDEMNIFICATION
You agree to indemnify and hold harmless Phantom Spirits 2.0 ApS, Shopify, and our respective affiliates, officers, employees and agents from any claims, liabilities, damages or costs (including reasonable legal fees) arising from: (1) your breach of these Terms; (2) your violation of any applicable law; or (3) your use of the Services.
SECTION 18 — GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of Denmark. Any disputes shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.
SECTION 19 — GENERAL
If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in full force. Our failure to enforce any right does not constitute a waiver. These Terms constitute the entire agreement between you and us regarding the Services.
We may update these Terms at any time. Material changes will be notified in accordance with applicable law. Your continued use of the Services after any changes constitutes acceptance of the updated Terms. The current version is always available at this page.
You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
